Under federal law, hemp (and hemp products) is considered legal if it has less than 0.3 percent THC on a dry weight basis. The 2018 Farm Bill legalized hemp-derived products that contain less than 0.3% THC by dry weight, if the products are from legally compliant hemp. The 2018 Farm Bill also included the Hemp Farming Act, which removed CBD (cannabidiol) and hemp from the definition of illegal marijuana. 

The majority of states follow this rule, fully legalizing the manufacture, sale, and possession of hemp-derived products. Nine states: California, Georgia, Hawaii, Minnesota, Mississippi, New Hampshire, New York, South Dakota, and Washington, have restrictions like age or derivative classes. Four states: Alaska, Idaho, Kansas, and Iowa, prohibit almost all hemp and cannabis products by either not allowing any full-spectrum hemp products or any THC. 

After the case of AK FUTURES LLC V. BOYD STREET DISTRO, LLC, No. 21-56133 (9th Cir. 2022) and in light of the Hemp Advancement Act being looked at by states it also appears that more states may be moving to regulating instead of restricting hemp products.

Hemp derived products are limited for purchase to adults ages 18 and over only, unless you live in Illinois, Indiana, Maine, Mississippi, Rhode Island, Tennessee, or Utah in which case you must be 21 years old. Kai Kandies’ contains 100% Hemp derived Delta 9 THC defined by the 2018 Federal Farm Bill, and  are legal for manufacture and sale in a majority of states as discussed above, as long as the product contains less than 0.3% THC by dry weight.
